Trademark Battle: CustomizedGirl.com vs. CustomGlamGirl.com

CustomGlamGirl.com battles it out with ERetailing’s CustomizedGirl.com. CustomGlamGirl.com who also owns Takeouttees.com filed seven trademark infringement claims (E’Stephenie Inc. v. E Retailing Associates, LLC, et al. 1:04-cv-01235-LJM-WTL.). The claims include unfair competition, copyright interference with prospective economic advantage and unjust enrichment but all were rejected. Thee were no trademarks for CustomGlamGirl.com in the state of Indiana or federal system and no evidence for the widely used terms “custom,” “glam,” and “girl” . These battles actually begain in 2004 fairly close after CustomizedGirl.com opened around March 2004 (CustomGlamGirl.com opened around March 2003 a year prior)

You probably have seen them both advertising in US weekly and it was confusing about who was who. Their websites even looked similar and customized girl even tried to take advantage of the confusion somewhat by creating a page dedicated to comparing the sites. In the end though, the courts found no issue with the similarities in the branding of the two sites.

    I purchased shirts from Customized Girl and their sizing charts are completely inaccurate! Do not purchase the youth shirts here. My neice is 6 and I purchased her the 10/12 size and it came and it looked like it was 3 sizes too small. The shirt looks like a half shirt on her and she is the smallest of the girls that I ordered the shirts for. I am completely unhappy and they DO NOT ALLOW RETURNS. Don’t believe what it says on the website!

    Received my order from customized girl today, shirts were very disappointing in the color of the artwork and printing, it’s very blah looking. I had ordered another shirt for a bparty and had asked for a quick turnover. I got nothing but static and if you will pay $24.00 more we will do it. Customer service uh, talk to a wall it would be better. They are supposedly in Ohio I live in Michigan so why can’t a tee shirt that is already produced be put in the mail today so I can receive it by Friday, well not possible if you won’t pay their ransom fee. Never will I place another order with them. The shirts they use for are also cheap and crappy not a happy customer!!!!

    I’m VERY interested in Customized Girl.

    I do A LOT of original custom graphics and I’m very good at coming up with original content.

    I noticed this about Customized Girl: I will place something new on my site and they will come “grab” it within a few weeks/days. They have now re-created quite a bit of my hard work. I want to be PAID for my ideas. That or I will RECREATE anything and EVERYTHING on their site and post it to my site. I’m keeping track of my copyrighted work and the time frames of when mine go up, vs when they show up on Customized Girl. I want to know who “designs” for them because I’m ready to play hardball.

    I have seen the same thing, the customized girl site are COPYCATS BIG TIME!! They copy designs, art, features and everything. Bad bad bad!

    The Customized Girl website has been ripping my custom artwork off as well. I’m not taking this sitting down though. I have an attorney going over my information, and I think you all should as well. I’m looking for other artists interested in taking legal action. I don’t want to post too much, but I will check back in the places I’ve posted this.
